Terms of use
1. Acceptance
By accessing or using the CodonForge website at codonforge.com (the "Site"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the Site. CodonForge ("we," "us," or "our") reserves the right to modify these Terms at any time. Your continued use of the Site after any changes constitutes acceptance of the revised Terms.
2. What this site is
The Site is an informational website describing CodonForge's web design services, portfolio work, pricing, and studio background. It is not itself a service agreement. Engaging CodonForge for a project requires a separate written agreement that specifies scope, deliverables, timeline, payment terms, and intellectual property assignment. Nothing on this Site creates a binding service contract.
Pricing shown on the Site (Launch, Platform, Series A) represents starting points and typical ranges based on scope. Final pricing for any project is determined after a scoping conversation and confirmed in a written proposal.
3. Intellectual property: site content
All content on the Site, including text, design, graphics, logos, case study descriptions, and code, is the property of CodonForge or its clients (where client work is displayed with permission) and is protected by applicable copyright and intellectual property law.
You may view, download, and print pages from the Site for personal, non-commercial reference, provided you do not modify the content and you retain all copyright and attribution notices. Any other reproduction, distribution, or commercial use of Site content requires our prior written consent.
The name "CodonForge" and associated logo are proprietary. You may not use them without our prior written consent.
4. Client work and portfolio display
Case studies and portfolio items displayed on the Site are shown with client knowledge. We do not display confidential materials or pre-launch work without explicit written approval from the client. If you are a current or former client and have concerns about how your project is described or displayed, please contact us at support@codonforge.com and we will respond within five business days.
5. Permitted use
You may use the Site for lawful purposes only. You agree not to:
- Use the Site in any way that violates applicable law or regulation.
- Reproduce or exploit any portion of the Site for commercial purposes without written consent.
- Use automated tools, bots, or scrapers to access, copy, or index Site content.
- Frame or embed the Site within another website without our prior written consent.
- Attempt to gain unauthorized access to any part of the Site or its infrastructure.
6. Contact form submissions
When you submit information through the Site's contact form, you are initiating a conversation about a potential project. Submitting a form does not create a client relationship, a binding engagement, or any obligation on CodonForge to accept your project.
Please do not submit confidential, proprietary, or sensitive business information through the contact form before a non-disclosure agreement is in place. CodonForge treats all inquiry content with discretion, but we cannot guarantee the confidentiality of information submitted through a general web form without a separate agreement.
How we handle personal information submitted through the Site is described in our Privacy Policy.
7. Third-party links
The Site may link to third-party websites including client sites, tools, or resources. These links are provided for reference only. CodonForge has no control over linked sites and accepts no responsibility for their content, practices, or accuracy. A link does not imply our endorsement of the linked site.
8. Disclaimers
THE SITE AND ALL CONTENT ON IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. CODONFORGE DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Pricing, timelines, and service descriptions on the Site are illustrative. Actual project scope, cost, and delivery schedule are determined through direct negotiation and confirmed in writing before any work begins.
Portfolio examples and case studies reflect work completed under specific briefs and with specific clients. Results for your project may differ based on scope, content complexity, and the nature of your platform.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CODONFORGE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THIS SITE, INCLUDING LOSS OF DATA, BUSINESS INTERRUPTION, OR LOST PROFITS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our liability for direct damages arising from use of this Site, if any, is limited to the greater of (a) amounts actually paid by you to CodonForge in the six months preceding the claim, or (b) one hundred euros (EUR 100). This limitation applies even where a remedy fails its essential purpose.
Some jurisdictions do not permit the exclusion or limitation of certain damages. Where applicable law prohibits limitations on liability, our liability is limited to the maximum extent permitted by that law.
10. Governing law
These Terms are governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Site that cannot be resolved by direct negotiation will be subject to the exclusive jurisdiction of the courts of Santa Clara County, California, USA.
If you access the Site from outside the United States, you are responsible for compliance with applicable local laws.
11. Changes to these terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will post a notice on the Site. Your continued use of the Site after any change constitutes acceptance of the revised Terms.
